    Report of conditions imposed on the CRICOS registration of Texila College Australia Pty Ltd (TCA)

    On 19 September 2023, TEQSA, under section 10B of the Education Services for Overseas Students Act 2000 (ESOS Act), imposed two (2) conditions on the CRICOS registration of Texila College Australia Pty Ltd (TCA):

    Condition 1: Overseas student enrolments

    The maximum number of overseas students that TCA may provide a course across all its locations must not exceed 550 overseas students.

    Condition 2: Overseas student recruitment and admissions

    By 31 December 2023, TCA must engage a suitably qualified independent expert to undertake a review of TCA's recruitment and admission practices, including the management of education agents. The expert and terms of reference of this review must be approved by TEQSA. The review should assess the effectiveness of the implementation of TCA's policies and procedures in ensuring:

    1. responsible recruitment of overseas students
    2. its education agents act ethically, honestly, and in the best interests of overseas students,
    3. its relevant governing bodies have sufficient oversight of risks in overseas student recruitment to maintain the provision of education of a satisfactory standard.

    By 30 April 2024, TCA must provide TEQSA the review report, evidence of consideration of the report, and any actions in response to the report, by its relevant governing bodies.

    Main reasons for the decision

    TEQSA made these decisions in light of substantial risks that Texila College Australia Pty Ltd (TCA) may not meet, or continue to meet, the requirements of Standards 2 and 4 of the National Code of Practice for Providers of Education and Training to Overseas Students 2018.

    On 13 September 2023 TEQSA revoked, under section 32 of the Tertiary Education Quality and Standards Agency Act 2011 (TEQSA Act), Condition 2 imposed on the registration of Group Colleges Australia Pty Ltd on 30 June 2021.

    On 21 September 2023 TEQSA varied, under section 32 of the Tertiary Education Quality and Standards Agency Act 2011 (TEQSA Act), Condition 1 also imposed on the registration of Group Colleges Australia Pty Ltd on 30 June 2021.

    Condition 1: (as varied) Student Performance Monitoring

    By 30 June 2024 GCA must provide to TEQSA:

    1. A report containing a comprehensive diagnostic analysis of the probable causes for observed rates and trends for student attrition for each accredited higher education course it offers, for the period from covering academic year 2022 and 2023. Data on attrition rates must be calculated in accordance with the definition used in the TEQSA Risk Assessment Framework.
    2. Evidence that attrition as defined in the TEQSA Risk Assessments and adjusted attrition rates are and will be regularly reported to the GCA Board of Directors and the Academic Senate, and
    3. Evidence of the actions and mitigating strategies that have and will be implemented to address any high rates of unadjusted attrition.

    Main reasons for the revocation decision

    TEQSA made the decision with regard to Condition 2 on the basis that it was satisfied that the condition is no longer necessary.

    TEQSA made the decision with regard to Condition 1 on the basis that the reporting required additional evidence and the risks cited had yet to be addressed.

    On 2 October 2023, TEQSA:

    • Imposed, under section 10B of the ESOS Act, one condition on the CRICOS registration of the SSR Higher Education Pty Ltd.

    ESOS Condition 1 - Admission, Recruitment, and Support of Overseas Students

    1. By 31 December 2024, SSR must engage a suitably qualified independent expert to undertake a review of SSR's first year of delivery to overseas students. The expert and terms of reference for this review must be approved by TEQSA. The review should assess the effectiveness of the implementation of SSR's policies and procedures in ensuring:
      1. responsible recruitment of overseas students
      2. its education agents act ethically, honestly and in the best interests of overseas students.
      3. adequate monitoring and support of overseas students
    2. By 31 March 2025, SSR must provide TEQSA the review report, evidence of consideration of the review report, and any actions in response to the report, by its relevant governing bodies.

    Main reasons for the decision

    TEQSA made this decision considering the significant risks in the recruitment, admissions and support of overseas students, and the heightened risks for a newly registered provider with no track record of delivery to overseas students. The decision to impose a condition was made on the basis that SSR Higher Education Pty Ltd (SSR), may not meet, or continue to meet, all objectives of the National Code of Practice for Providers of Education and Training to Overseas Students 2018 in relation to the recruitment, admission and support of overseas students.

    Application to withdraw decision.

    In accordance with section 10B(1)(b) of the ESOS Act, TEQSA may vary or revoke a condition imposed on the registration of a registered provider at any time. TEQSA will consider any application by a provider for variation or revocation of a condition.
