Imposition of registration conditions

Report on a condition imposed on registration of The Institute of Creative Arts and Technology Pty Ltd (formerly Macleay College Pty Ltd)

On 26 April 2023 TEQSA imposed, under section 32 of the Tertiary Education Quality and Standards Agency Act 2011 (TEQSA Act), one condition on the registration of The Institute of Creative Arts and Technology Pty Ltd.

  1. By 31 May 2023, The Institute of Creative Arts and Technology Pty Ltd. (ICAT) must submit to TEQSA:
    1. Evidence that ICAT has developed and implemented a compliance register, that lists all of its obligations under relevant legislation, including the Tertiary Education Quality and Standards Agency Act 2011 (TEQSA Act) and the Higher Education Standards Framework (Threshold Standards) 2021. The register must detail how compliance with these obligations is managed and monitored. This register will include appropriate business continuity plans for each accredited course of study.
    2. Evidence that ICAT has developed and implemented a delegations register that sets out the functions which ICAT's Corporate Board has authorised particular officers and bodies to carry out regularly, including delegations for the establishment of policy, procedures and guidelines, and financial, personnel, academic and other administrative and general authorities and functions.
  2. By 1 August 2023 ICAT must provide TEQSA with:
    1. An independent evaluation of the Corporate and Academic Boards' performance and effectiveness.

      Prior to engaging the reviewer to fulfil this requirement, ICAT must submit to TEQSA information about the prospective reviewer and the review terms of reference for TEQSA's approval.

    2. A copy of ICAT response to the review, approved by the Corporate Board.
    3. Evidence that ICAT has undertaken a review of the effectiveness of the register of delegations, including whether the exercise of delegated decision-making power has assisted in the ICAT's efforts to return to compliance.

Main reason for the decisions

TEQSA made the decision to impose the above condition on the basis of the findings of a compliance assessment which identified material risks against several standards in Domain 6 of the Higher Education Standards Framework (Threshold Standards) (2021).
